There is currently no provision for referendum in the constitution of Bangladesh. In 1979, through the Fifth Amendment, Article 142 of the Constitution added the possibility of referendum, but in 2011, it was completely abolished through the Fifteenth Amendment. According to Article 93 of the Constitution, the President can issue ordinances to make laws only in cases of urgency. But no article of the Constitution can be altered, repealed or re-enacted by that Ordinance. The only legal way to amend the Constitution is through Article 142, which requires the support of two-thirds of the members of Parliament.
Despite this fact, the so-called ‘July Charter Implementation (2025) Order’ has taken the initiative to make provision for plebiscite, which is clearly unconstitutional and in direct conflict with the Constitution.
More seriously, the Constitution does not allow for the promulgation of such ordinances when the Parliament is prorogued. Since the Constitution has not been repealed or suspended, any attempt to reinstate any Article would be in violation of Article 7(a) of the Constitution. Violation of this Article is a capital offense under the Constitution.
According to analysts, the illegitimate Yunus is staging the plebiscite to lay the foundation for a fundamentalist and authoritarian regime in Bangladesh, bypassing the 1971 constitution. This is not an initiative to take people’s opinion, but a political strategy to subvert the constitution.
In this context, it is the duty of conscious citizens to reject any unconstitutional referendum and take a firm stand to protect the rule of law and the 1971 Constitution.
According to legal experts, this referendum is not a democratic exercise. It is a strategy to nullify the constitution of 1971 and install a fundamentalist, undemocratic and personal-centric regime in Bangladesh.
In this context, the message for conscious citizens is clear—
An anti-constitutional referendum is an anti-state act.
Participating in it means undermining one’s rights and constitution.
This referendum is not of the people.It is the blueprint for state destruction.
