Biased and opaque judicial processes at international criminal tribunals undermine the rule of law
Statements of 115 poets, journalists, writers and artists. Hakikul Islam Khokon
Hundreds of artists, writers, journalists, poets, actors, producers condemn the statement against the unconstitutional verdict against Bangladesh Awami League president and former five-time successful Prime Minister Sheikh Hasina, weThe undersigned are artists, writers, poets, actors and producers of Bangladeshi origin
We have been representing Bangladesh to spread Bengali art literature in Bangladesh and worldwide. Humanity, equality and justice, non-communalism were the main values in Bangladesh achieved through the liberation war.Expressing concern.
In this judgment, former Prime Minister Sheikh Hasina has been sentenced to death for crimes against humanity in her absence, which has caused deep concern, frustration and intense fear among Bangladeshi expatriates living in Bangladesh and various countries around the world. Starting from various international human rights organizations, the international media have also reported on the execution order and trial process against Sheikh Hasina.raised questions about
Instead of establishing legitimate justice and accountability, this judgment has set a dangerous and dangerous precedent of political vendetta under the guise of legal formality. The verdict has failed to gain acceptance and credibility even with international organizations due to the extraordinary speed in the completion of the trial, the fundamental lack of transparency and the complete denial of the fundamental legal rights of the accused.has been criticized.
Amnesty International stated unequivocally: “These trials and punishments are neither fair nor just. The victims need justice and accountability, but the death penalty only exacerbates human rights violations. It is the ultimate cruel, degrading and inhumane punishment and has no place in any judicial process.” Secretary-General Agnes Callamard specifically emphasized the lack of ICT-freedomhas and has a history of politically influenced judicial processes.
Human Rights Watch (HRW) supports these concerns, stating: “All criminal proceedings must meet international fair trial standards. Trial in absentia and trial in absentia fundamentally undermines the right to a fair trial.”
HRW also noted that Sheikh Hasina is deprived of her right to appoint a lawyer of her choicewas deprived and the lawyers appointed for the defense were not able to effectively cross-examine witnesses or present counter-evidence. There is no example in history of political justice process in such a speedy time in the world.
The Office of the United Nations High Commissioner for Human Rights (OHCHR) deplored the imposition of the death penalty, saying: “We oppose the death penalty in all circumstances. This judgment is a reprieve for the victims. This marks a critical moment, but justice must be delivered through a fair and impartial process.” This consensus statement by global human rights organizations strongly supports our concerns about the extreme politicization of justice and the deep erosion of democratic norms in Bangladesh.
Our Position We are united in the conviction that the rule of law must be upheld without prejudicewill be
We believe:
• Justice must be impartial, transparent and completely free from political or government interference.
• Every citizen—regardless of political affiliation—is entitled to a fair, robust and transparent trial in accordance with international legal standards.
• ICT’s conduct in this case violates basic international legal norms and seriously undermines public confidence in the independence of the Bangladeshi judiciary.by doing
We are deeply concerned about:
• Depriving Sheikh Hasina of legal representation and mandatorily appointing a lawyer close to the government without her consent.
• Credible reports of intimidation by ‘mobs’ (mobs) when attempting to represent lawyers appointed to defend themselves.
• Absence of international observers and longstanding institutional independence of the Tribunallack of
Our demand for justice and accountability
In the face of this judicial crisis, we make the following urgent demands to the Government of Bangladesh and the concerned authorities:
• Independent international investigation: We demand a full, independent international investigation into the July–August 2024 killings and all related human rights violations.
• Annulment and retrial: Immediate annulment of the present judgment and aInitiate a retrial under a fully transparent and impartial process, which strictly adheres to established international fair trial standards.
• Judicial protection: Immediate and complete protection of the judiciary from all forms of political and administrative interference.
• Equal Legal Rights: Ensuring equal legal rights for all, including the appointment of a lawyer of choice and freedom to present evidence without hindranceFreedom included.
• Judgments based on law: All future judgments should be based only on law, truth and verifiable evidence—not political pressure, prejudice or bias.
We steadfastly support democracy, freedom of the press and the rule of law. Justice is the lifeblood of any nation; When a state abandons it, it leads to deep crisis. Bangladesh and its people are such a government andDeserves a judiciary that upholds these sacred principles. Signed: (1) diplomat, researcher and writer Dr. Haroon Al.
